Privacy and Cookie Policy
Regarding the "vivilo.ai" website (the "Site"). This policy describes the characteristics of the processing of personal data ("Data") collected through the Site and the use of cookies and any other tracking tools.
This policy contains details on the collection, type, purpose, and methods of data processing, in compliance with Regulation (EU) 2016/679 ("GDPR"), Legislative Decree 196/2003 ("Privacy Code"), and the "Guidelines on cookies and other tracking tools" issued by the Italian Data Protection Authority on June 10, 2021.

Data Controller
The Data Controller is Jubatus S.r.l. (Tax ID/VAT No. 04774460408), with registered office at Via Martiri della Libertà 14/C, 47521 Cesena (FC) (the "Data Controller"), who can be contacted at the email address: privacy@jubatus.it.
The Data Controller has appointed a Data Protection Officer ("DPO"). The designated party is Complaion S.r.l., who can be contacted via email at: dpo@jubatus.com.

Types of data and cookies processed
2.1 Data provided by users
The Data Controller collects the Data that each user provides when communicating with the Data Controller, sending requests or communications via email, or by filling out the online form on the Site.
Users can communicate their identification data (such as name, surname, role) and contact details (email and phone number), as well as any further personal data that each user intends to share, through these methods.
Providing the data requested in the form is necessary to allow the Data Controller to respond to the request; failure to provide it may prevent the request from being processed.
The Data Controller invites users not to provide Data unless it is absolutely essential for the purposes described in this policy.
2.2 Cookies
The Site collects browsing data and uses tracking tools ("Cookies"). Cookies are small text strings that the Site sends to the user's device, where they are stored to be retransmitted to the same Site upon the next visit.
The Site uses the following types of cookies:
a) Technical cookies
These are essential for the proper functioning of the Site and for providing the requested service. They do not require user consent. They are divided into:
Navigation or session cookies: these ensure the normal browsing and use of the Site.
Functionality cookies: these allow the user to browse based on a set of selected criteria (e.g., language, consent storage) to improve the service.
b) Analytical cookies (Analytics)
Subject to the user's specific consent, the Site uses third-party analytical cookies to collect information, in aggregate form, on the number of users and how they visit the Site, in order to perform statistical analysis to optimize the services offered.
In particular, the Site uses the Google Analytics 4 (GA4) service provided by Google LLC.
c) Profiling and marketing cookies
Subject to the user's specific consent, the Site also uses profiling and marketing cookies, including those from third parties, aimed at:
measure the effectiveness of advertising campaigns;
track user interactions with the Site;
create custom audiences;
carry out remarketing activities and offer personalized promotional communications based on the user's browsing behavior.
For these reasons, in accordance with the principle of maximum caution and in line with the guidelines of the Data Protection Authority, these cookies are installed only after obtaining your explicit consent, expressed through the dedicated banner.
These cookies are installed only after the user has provided free, specific, informed, and unambiguous consent.

Purposes and legal basis for processing
The Data is processed for the following purposes.
a) Respond to contact requests
Data provided voluntarily by users via the form or email is processed to fulfill information requests.
Legal basis
Performance of pre-contractual measures taken at the request of the data subject (Art. 6, par. 1, let. b) GDPR).
b) Ensure the Site functions correctly
Technical Cookies are used to ensure the proper operation of the Site and to allow for secure and efficient navigation.
Legal basis
Art. 122 of Legislative Decree no. 196 of June 30, 2003 (as referenced in the "Guidelines on cookies and other tracking tools"), which provides a specific exemption from the consent requirement for technical tools, as they are "strictly necessary" for the provision of the service; legitimate interest of the Data Controller pursuant to Art. 6, para. 1, point (f) GDPR to ensure the functioning of the Site.
c) Perform statistical analysis on Site usage
Subject to the data subject's consent, Analytical Cookies are used to collect data and generate statistics on Site usage, in order to understand how visitors interact with the services and to improve the structure and navigation logic.

d) Carry out profiling, advertising measurement, and remarketing activities
Subject to the data subject's consent, profiling and marketing cookies are used to analyze user interactions with the Site, measure the effectiveness of promotional campaigns, create audiences, and offer personalized content or advertisements, including on third-party platforms.

Upon first accessing the Site, the user sees an information banner containing a brief notice regarding the use of cookies and any other tracking tools.

Options regarding non-technical cookies must be set to "deny" by default, and consent can only be validly given through a clear, affirmative action by the user. In the absence of consent, no analytical, profiling, or marketing cookies will be installed or activated; only the necessary technical cookies will remain in use.
Users may modify or revoke their previously expressed preferences at any time using the specific function made available on the Site, without prejudice to the lawfulness of the processing based on the consent provided prior to the revocation.

Data Recipients
Data may be shared with the following categories of subjects (the "Recipients"):
Authorized personnel of the Data Controller: employees and collaborators of the Data Controller who have been specifically trained and authorized to process data for the indicated purposes (e.g., administrative, sales, and IT staff);
Technical and IT service providers: third-party companies that provide services for the management and maintenance of the Site and corporate information systems, typically acting as Data Processors pursuant to Art. 28 of the GDPR;
Statistical analysis service providers: companies that provide tools for the aggregate analysis of browsing data, such as Google for the Google Analytics service, which typically acts as a Data Processor;
Advertising, profiling, and remarketing service providers: third parties that, subject to the user's consent, receive data or information collected via cookies and other tracking tools for campaign measurement, audience creation, remarketing, and personalization of promotional messages;
Consultants and freelancers: entities providing legal, tax, or commercial advice to the Data Controller, to the extent necessary to perform their duties;
Competent authorities: judicial and administrative authorities, in compliance with legal obligations.

Data retention period
Data provided by users for contact requests will be kept for the time necessary to fulfill the request and, in any case, for a maximum period of 12 months from collection, unless a contractual relationship is established.
The retention period for each Cookie is specified in the table in Annex 1.

Regarding the aforementioned processing of personal data, users may exercise the following rights at any time, under the conditions and within the limits set forth in Articles 15 to 22 of the GDPR, by sending an email to privacy@jubatus.it:
